Ante la solidez de las pruebas y la rápida respuesta investigativa de la Fiscalía General de la
Nación, Andrés Fernando Medina Rodríguez, alias El Capi; y Ciro Alfonso Gutiérrez Ballesteros,
alias Ciro, aceptaron mediante preacuerdo su responsabilidad en la acción terrorista contra la
Brigada 30 del Ejército Nacional con sede en Cúcuta (Norte de Santander), que dejó varias
personas heridas y cuantiosos daños materiales el 15 de junio de 2021.
La negociación judicial estableció que, por el reconocimiento libre y voluntario, no recibirían
rebajas ni beneficios judiciales, y se someterían a sentencia.
En ese sentido, un juez penal especializado de Cúcuta (Norte de Santander) avaló el preacuerdo
y condenó a alias El Capi a 35 años de prisión, y a alias Ciro a 33 años y dos meses de prisión,
penas que se harán efectivas en establecimiento carcelario.
La decisión los declaró responsables de los delitos de: terrorismo agravado, homicidio agravado
en grado de tentativa (por 44 ciudadanos colombianos que quedaron heridos), concierto para
delinquir agravado, daño en bien ajeno agravado, y fabricación, tráfico y porte de armas,
municiones de uso restringido, de uso privativo de las Fuerzas Armadas o explosivos agravado.
Un fiscal de la Dirección Especializada contra las Organizaciones Criminales estableció que los
dos sentenciados actuaron como articuladores del ataque y mantuvieron contacto directo con
los cabecillas de las disidencias del frente 33 de las Farc para la planeación y ejecución.
En ese sentido, Medina Rodríguez llevó una camioneta de gama alta hasta Tibú (Norte de
Santander), donde fue acondicionada con explosivos; y, el 15 de junio de 2021, entró el
automotor a las instalaciones militares para que detonara, aprovechando su condición de
exintegrante del Ejército Nacional.
De otra parte, Gutiérrez Ballesteros, a bordo de una motocicleta, acompañó todos los traslados
del carro bomba, y esperó y recogió a alias El Capi frente a la Brigada 30 para ayudarlo a escapar.
El fallo conocido hoy quedó en firme y es el segundo que se obtiene por este hecho violento. En
noviembre de 2022, fue condenado a 30 años y 4 meses de prisión Aurelio Suárez Pérez, alias
Aurelio, el señalado cabecilla de la célula terrorista que apoyó el atentado.
